The Privatization Authority is established as a corporate body under Section 8 of the Privatization Act, 2025. It advises Government, facilitates and implements approved privatization proposals, coordinates programme delivery, monitors outcomes, and maintains transparent public disclosure.

Statutory Functions
Section 9 sets out the Authority’s responsibilities across advisory work, implementation, monitoring, research, disclosure and stakeholder engagement.
Advise the Government on all aspects of privatization of public entities.
Facilitate the implementation of Government policies on privatization.
Implement the Privatization Programme.
Implement specific Privatization Proposals in accordance with the Privatization Programme.
Collaborate with organizations within or outside Kenya in furtherance of the objects of the Act.
Prepare long-term divestiture sequence plans.
Monitor and evaluate implementation of the Privatization Programme.
Carry out public education and stakeholder engagement on privatization matters.
Undertake research and maintain information on privatization and public enterprise reform.
Publish programme updates, notices, reports, and disclosures required by law.
